NeKu.AI Terms of Use

These Terms and Conditions govern the use of the NeKu.AI platform and related services provided by NeKuDos Technology (“NeKu.AI”, “we”, “us”, or “our”). By accessing or using our website [https://neku.ai] or the application at [https://app.neku.ai], you agree to be bound by these Terms.

If you do not agree with these Terms, you must stop using the Services immediately.

1. Eligibility and Account Responsibility

  • You must be at least 13 years old to use the Services. If you are under 18, you must have permission from a parent or legal guardian.
  • You agree to provide accurate and complete account information and keep it updated.
  • You are responsible for maintaining the confidentiality of your login credentials and for all actions taken under your account.
  • If you believe your account has been accessed without authorization, you must notify us immediately.

2. Permitted and Prohibited Use

You may use the Services only for lawful business purposes and in compliance with these Terms.

You must not:

  • Violate any intellectual property, privacy, trademark, or other rights of third parties
  • Attempt to reverse engineer, modify, disrupt, or interfere with the platform
  • Use the Services to build, train, or improve competing AI products without written permission
  • Misrepresent AI generated content as human created where it may mislead others
  • Bypass usage limits, security controls, or access restrictions
  • Upload or transmit harmful, abusive, defamatory, hateful, discriminatory, or illegal material
  • Use the platform for critical decisions in regulated industries without appropriate safeguards

We reserve the right to suspend or restrict access if misuse is detected.

3. User Content and Output

  • You are responsible for all data, prompts, files, and materials you submit to the platform (“User Content”).
  • You retain ownership of your User Content.
  • You grant NeKu.AI a limited license to process User Content and generated output solely to provide, maintain, and improve the Services.
  • If you are using the platform on behalf of a business, you represent that you have authority to do so and agree to indemnify NeKu.AI against claims arising from your use of the Services.

4. Privacy and Data Protection

  • Our Privacy Policy explains how we collect, use, store, and protect personal data.
  • By using the Services, you consent to our data practices as described in the Privacy Policy.
  • If additional rights apply under local laws, such as GDPR, we will comply with those requirements.

5. Subscription, Payments, and Refunds

  • Paid plans and billing are managed through PayTR as our Merchant of Record.
  • Failure to complete payment may result in suspension or termination of access.

6. Disclaimers and Limitation of Liability

  • The Services are provided on an “as is” and “as available” basis.
  • We do not guarantee accuracy, reliability, or uninterrupted access.
  • To the maximum extent permitted by law, NeKu.AI is not liable for:
    • Loss of data
    • Business interruption
    • Indirect or consequential damages
    • Decisions made based on AI generated output

Your use of the platform is at your own risk.

7. Changes to the Services or Terms

  • We may update these Terms at any time.
  • Changes become effective when posted on the website or within the platform.
  • Continued use of the Services after changes means you accept the updated Terms.
  • We may modify, suspend, or discontinue features without liability.

8. Termination

We may suspend or terminate your account immediately if:

  • You violate these Terms
  • Required by law or regulatory request
  • Security risks are identified

You may stop using the Services at any time. Termination does not affect rights or obligations that have already occurred.

9. Dispute Resolution

  • Any disputes will be resolved through binding arbitration administered by the Istanbul Arbitration Centre (ISTAC).
  • The arbitration will take place in Ankara, Turkey.
  • Class action lawsuits are not permitted.
  • You may opt out by notifying us in writing within 30 days of accepting these Terms.

10. Governing Law

These Terms are governed by the laws of Turkey, excluding conflict of law principles.
