Welcome to NeKu.AI (“Platform”). These Terms of Use (“Terms”) govern your access to and use of our chat services, applications, website, and related features (collectively, “Services”). By entering the chat, you agree to follow and be bound by these Terms.

1. Eligibility & Account Responsibility

  • You must be at least 13 years old. If you are under 18, you must have parental or guardian permission.
  • You agree to provide accurate, complete information when creating an account.
  • You are responsible for all activity under your account and for keeping your credentials secure.

2. Permitted & Prohibited Uses

You may use our Services only if you follow all rules and applicable laws. Specifically, you must not:

  • Violate any person’s rights, such as copyright, trademark, privacy, or publicity rights.
  • Reverse engineer, decompile, or harvest data from our Platform.
  • Use our Services to create or train competing AI models without our written permission.
  • Mislead others by attributing AI-generated output as human-generated.
  • Bypass any usage restrictions, including rate limits or content filters.
  • Engage in illegal, harmful, abusive, defamatory, discriminatory, or violent activities.
  • Use the chat for high-stakes decisions in regulated domains without proper safeguards.

3. Content & Output

  • You are responsible for the inputs you submit and how you use the chat Output.
  • You grant NeKu.AI a license to use your inputs and the generated Output to maintain and improve our Services.
  • If you represent a business entity, you agree to indemnify NeKu.AI against any third-party claims related to your use.

4. Privacy & Data

  • Our Privacy Policy governs how we collect, use, and share data.
  • Using the chat implies your consent to our data practices.
  • If additional privacy rights apply in your jurisdiction, we will comply accordingly.

5. Disclaimers & Limitations of Liability

  • The Services are provided “as-is” and “as available.” We expressly disclaim all warranties, whether express or implied.
  • To the legal maximum, we exclude liability for any damages resulting from your use of the Services.

6. Changes & Termination

  • We may update these Terms at any time. We’ll notify users via the Platform, and changes take effect when posted.
  • Continued use after updates indicates acceptance.
  • We may suspend or terminate access at any time without notice or liability.

7. Dispute Resolution

  • You and NeKu.AI agree to settle disputes through binding arbitration administered by the Istanbul Arbitration Centre (ISTAC), not in court, unless you opt out in writing within 30 days of first accepting these Terms.
  • The arbitration shall take place in Ankara, Turkey.
  • Class‑action waivers apply.

8. Governing Law

These Terms are governed by the laws of Turkey, excluding its conflict‑of‑law rules.
